By booking or purchasing photography services from Home Space Media ("Photographer," "we," "us," or "our"), the client ("Client," "you," or "your") agrees to the following Terms and Conditions.
1. Services Provided
Home Space Media provides professional real estate photography services for residential and commercial properties.
The service includes professional interior and exterior property photography, image editing, and digital delivery of the final photographs.
All photography services are provided according to the service details and pricing communicated at the time of booking.
2. Booking and Scheduling
• All photography appointments must be scheduled in advance.
• An appointment is not confirmed until the Photographer provides booking confirmation.
• The Client is responsible for providing the correct property address, access instructions, contact information, and any special requests.
• The Client must ensure the property is accessible at the scheduled appointment time.
• The Photographer reserves the right to decline or reschedule appointments when necessary.
3. Property Preparation and Access
The Client is responsible for ensuring the property is ready for photography before the scheduled appointment.
This includes, but is not limited to:
• Cleaning and decluttering all rooms.
• Making beds and organizing furniture.
• Removing personal items, trash, and unnecessary objects.
• Turning on interior lights and opening blinds or curtains.
• Ensuring landscaping and exterior areas are presentable.
• Securing pets and removing occupants when appropriate.
• Obtaining permission for photography from the property owner.
Home Space Media is not responsible for cleaning, staging, organizing, moving furniture, or preparing the property.
If the property is not ready upon arrival, Home Space Media may proceed with the appointment, photograph only the areas that are ready, or reschedule the appointment subject to applicable fees.
4. Pricing and Payment
• All services are subject to the pricing communicated at the time of booking.
• Payment is due upon delivery of the completed photographs unless otherwise agreed in writing.
• Additional fees may apply for travel outside the standard service area or special requests.
• Home Space Media reserves the right to withhold final image delivery until outstanding balances are paid.
• Late or unpaid invoices may be subject to reasonable late fees where permitted by law.
• Prices are subject to change, but confirmed bookings will retain the agreed-upon pricing.
5. Cancellations and Rescheduling
The Client must provide at least 24 hours' notice to cancel or reschedule an appointment.
• Cancellations made with less than 24 hours' notice may incur a cancellation fee.
• Same-day cancellations or failure to provide property access may result in a fee of up to 50% of the scheduled service price.
• No-shows or inaccessible properties may be subject to a trip or cancellation fee.
• Weather-related rescheduling for exterior photography will be handled at Home Space Media's discretion.
• Home Space Media reserves the right to reschedule appointments due to severe weather, illness, emergencies, unsafe conditions, or circumstances beyond reasonable control.
Any applicable cancellation fees will be communicated before or at the time of booking.
6. Photography and Image Delivery
• Edited photographs will be delivered through an online gallery or another agreed-upon delivery method.
• Standard delivery time is 48 hours after the photography appointment, unless otherwise agreed.
• The number of delivered images will depend on the property and the Photographer's professional judgment.
• Home Space Media determines the final image selection and editing style.
• Unedited RAW files and original camera files are not included.
• The Client is responsible for downloading and saving delivered photographs within the gallery availability period.
7. Image Editing and Retouching
• Standard editing may include:
• Exposure and brightness adjustments.
• Color correction and white balance.
• HDR blending.
• Straightening and perspective correction.
• Window exposure adjustments.
• Minor visual enhancements.
• Advanced editing, object removal, virtual staging, sky replacement, extensive retouching, or other special requests may incur additional fees.
Home Space Media will not digitally alter property features in a way that materially misrepresents the property's actual condition, size, features, or appearance.
8. Copyright and Image Usage Rights
• All photographs and other creative materials produced by Home Space Media remain the intellectual property and copyrighted work of the Photographer.
• Upon full payment, the Client receives a non-exclusive, non-transferable license to use the delivered images for marketing and advertising the specific property photographed.
Permitted uses include:
• MLS listings, subject to applicable MLS rules.
• Real estate websites.
• Social media marketing.
• Property listing advertisements.
• Brochures and other property marketing materials.
The Client may not:
• Sell, sublicense, or redistribute images to third parties.
• Transfer images to another agent, brokerage, or company for use on a different property.
• Use images for unrelated commercial purposes.
• Remove copyright or ownership information where applicable.
• Claim authorship of the photographs.
• Additional licensing or usage rights must be approved in writing by Home Space Media.
9. Photographer's Portfolio and Marketing Rights
Unless the Client requests otherwise in writing before the appointment, Home Space Media may use selected photographs for business promotion, including:
• Website portfolios.
• Social media accounts.
• Advertising and marketing materials.
• Photography samples and promotional galleries.
• Home Space Media will not knowingly publish confidential information or disclose private access details.
• Clients who require confidentiality or restricted image use must notify Home Space Media before the scheduled appointment.
10. Property Access and Client Authorization
• The Client represents and warrants that they have obtained all necessary permissions and authorizations to allow Home Space Media to enter and photograph the property.
• The Client is responsible for obtaining consent from property owners, occupants, tenants, or other authorized parties as necessary.
• Home Space Media is not responsible for disputes arising from unauthorized access or photography resulting from inaccurate or incomplete information supplied by the Client.
11. Weather and Unforeseen Circumstances
• Home Space Media cannot guarantee specific lighting, weather, landscaping, seasonal conditions, or other environmental factors.
• Home Space Media may recommend rescheduling when weather conditions negatively affect the quality or safety of the requested services.
• Home Space Media is not responsible for delays or interruptions caused by circumstances beyond reasonable control, including severe weather, power outages, access restrictions, emergencies, or technical disruptions.
12. Client Satisfaction and Revisions
• Home Space Media strives to provide professional, high-quality images consistent with the agreed-upon services.
• If the Client identifies an editing issue or a discrepancy with the agreed-upon services, the Client must notify Home Space Media within 48 hours of delivery.
• Reasonable corrections to editing errors will be addressed at no additional charge.
• Changes in editing preferences or additional image requests outside the original service may incur additional fees.
• Reshoots resulting from the property being unprepared, inaccurate booking information, or changes requested by the Client may be subject to additional charges.
13. Liability and Property Safety
• The Client is responsible for ensuring the property is reasonably safe and accessible.
• Home Space Media reserves the right to refuse entry or discontinue services if unsafe conditions are identified.
• The Photographer will exercise reasonable care while working at the property but is not responsible for pre-existing property damage, defects, hidden hazards, or conditions outside the Photographer's control.
• To the extent permitted by applicable law, Home Space Media's liability arising from a service will be limited to the amount paid for the specific service giving rise to the claim.
• Nothing in these Terms excludes liability that cannot legally be excluded or limited.
14. Limitation of Services and Results
• Home Space Media does not guarantee that photography services will result in a property sale, increased listing views, higher offers, or any specific marketing outcome.
• Photography is a visual marketing service, and results may vary depending on market conditions, property characteristics, pricing, and other factors outside the Photographer's control.
15. Privacy and Confidentiality
• Home Space Media respects the privacy of clients, property owners, and occupants.
• The Client should remove sensitive documents, personal photographs, valuables, financial information, and other private materials before the appointment.
• Home Space Media will take reasonable precautions when handling and storing photographs and client information.
16. Termination of Services
• Home Space Media reserves the right to refuse, suspend, or terminate services if the Client:
• Fails to make required payments.
• Provides false or misleading booking information.
• Fails to provide authorized property access.
• Behaves abusively or threatens the safety of the Photographer.
• Requests services that violate applicable laws or regulations.
• Any outstanding payment obligations will remain due as permitted by law.
17. Governing Law
These Terms and Conditions shall be governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
Any disputes arising from these Terms and Conditions shall be handled in the appropriate courts located in Illinois, unless otherwise required by applicable law.
18. Changes to These Terms
• Home Space Media reserves the right to update or modify these Terms and Conditions as necessary.
• Updated terms will be published on the business website or otherwise communicated to clients.
• The terms applicable to a particular booking will be those agreed upon at the time of booking, unless the parties agree otherwise in writing.
19. Agreement and Acceptance
By scheduling, booking, or purchasing photography services from Home Space Media, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
